114: Just tell me whether the goal has been achieved!

Blank retroactivity is a rule within the principle of non-retroactivity of law.

Many people feel this term is very high-sounding, but it's actually not difficult at all.

Non-retroactivity of law, simply put, means that current laws cannot govern past events.

And this thing called blank retroactivity is also known as new regulation retroactivity.

In layman's terms, if something wasn't regulated before but is now, then past events must be handled according to the current regulation.

So why does such a thing exist? It's simple: it stems from the rule that judges cannot refuse to render judgment.

The rule that judges cannot refuse to render judgment: you understand it just by reading the sentence. Don't worry about those obscure legal jargons; you can understand it directly by its literal meaning.

It means that when a judge hears a case, he cannot refuse to rule on the grounds that there is no current regulation. He has to issue a judgment even if he has to make it up himself.

So, if there was no regulation before, the judge had to figure it out himself. Now that there is a regulation, what to do? Perfect, both past and present can follow this regulation.

This is blank retroactivity, very easy to understand.

Zhou Yun's meaning was very clear: the current regulation did not exist before, so the principle of blank retroactivity should be applied, meaning that past events should also be judged according to the current regulation.

It's like providing a supplementary regulation for the original case.

It still sounds a bit like playing dirty, but it's fine in legal logic.

And in the video, Zhou Yun also explained the principles very clearly in extremely explicit and easy-to-understand language.

This is also the fourth Zhou's Law: speak human language to humans, and ghost language to ghosts.

Many legal professionals, especially some lawyers, always use legal jargon when facing clients. As a result, after they finish speaking, the client is still confused and doesn't know what they were talking about.

This is a sign of being brainless.

It's not that legal jargon cannot be spoken, it's that you don't need to speak it to clients, because some clients don't understand what you're saying.

Professionalism is not demonstrated at this time.

When facing clients, one should speak in plain language they can understand, while legal jargon should be reserved for the judge and Lawyer Fang.

So Zhou Yun was like this during his previous livestreams, always speaking in plain language.

Naturally, it was the same in the video. He had to speak in a way that everyone could understand what he was saying and how his logic was reasoned.

"So, everyone should understand now, right? This is essentially using the sword of the current dynasty to execute an official of the previous dynasty, and it can truly execute him."

Wang Shenggang listened to this sentence, and he felt he understood it instantly.

"That Dong Yunliang, he wrote so much stuff, and I couldn't understand a lot of it. Lawyer Zhou's explanation is much better; I understood it right away."

After watching the video, Wang Shenggang suddenly felt terrifyingly strong.

Law seems to be just like this, I feel like I understand everything!

While thinking, Wang Shenggang went to look at the comments. As expected, the comment section had already exploded.

Or rather, Zhou Yun's method left netizens somewhat speechless.

Because Zhou Yun had already said in the video, 'Don't mind how much my method costs, and don't mind what my actions are like. Just tell me if I achieved my goal.'

What was the goal? The goal was to push certain units to create regulations in this area.

So if I make a big fuss, make it more serious, and create some value, then they will naturally create regulations.

Not only that, once this regulation is out, Zhou Yun doesn't even need to say anything; countless legal experts will naturally perfect the theory for him.

You want to refute it, right? First, look at who issued this approval: it's the Supreme People's Court.

So, is an approval issued by the Supreme People's Court really that powerful?

Yes, it's that powerful. Approvals and judicial interpretations have equivalent legal effect, and judicial interpretations have legal force.

You're not convinced, right? There's a regulation.

Article 5 of the 'Regulations on Judicial Interpretation Work' issued by the Supreme People's Court stipulates: 'Judicial interpretations issued by the Supreme People's Court have legal effect.'

Just kidding... this regulation really exists, but the true source of law is Article 119 of the 'Legislation Law'.

In short, netizens are now dumbfounded.

"I... I want to say something but I don't know what to say, but I also feel this operation is too outrageous, so what exactly was Lawyer Zhou thinking?"

This person is clearly a fan, speaking a bit euphemistically.

And the one below spoke a bit more directly.

"I'll just say it directly: is Lawyer Zhou perhaps a bit mentally... off? Otherwise, why would he do something like this, just to win the argument?"

"Yeah, this investigation must have involved a huge investment. I honestly feel Lawyer Zhou didn't need to do this. Any clear-headed person could see that person named Dong was just trying to gain popularity."

Everyone was discussing in the comment section, and some people started showing off.

These were the university students who were previously found in Changdong three cities.

"Holy crap, I was almost suffocated! We helped organize evidence for a long time and wanted to talk about it, but we signed a confidentiality agreement."

"Now I can finally say it!"

After this university student's comment was posted, someone quickly asked, "You guys were scared like this just by signing a contract?"

The university student quickly retorted, "Holy crap, there's such a high penalty for breach of contract! Lawyer Zhou is so serious; he wouldn't sue? Will you pay the money then?"

"All of us are law students. Other than that, the consequences of contract breach are very clear..."

Netizens were discussing, and in Magic City, Dong Yunliang had just finished class and returned to his office when his phone rang.

"Hello, what's wrong? Zhou Yun posted a video? Let him post it, what's there to be afraid of..."

His friend on the phone was shouting, "Go see for yourself, that person is truly f*cking crazy! He spent so much money just to win against you, I'm speechless!"

Listening to his friend's incoherent voice, Dong Yunliang didn't bother saying anything else. He quickly opened his phone, found the other party's account, and clicked into it.

As he watched, Dong Yunliang was utterly stunned.

Especially since the other party made it very clear that he did this investigation solely to win against him, and it had nothing to do with anything else...

At that moment, Dong Yunliang thought of the previous reports: three cities launched large-scale special rectification actions, and a bunch of people were arrested.

So, roughly speaking, all these things actually had to be attributed to him?

Coupled with the subsequent blank retroactivity, all his theories were shattered by the other party.

After all, no matter how much theory you talk about in law, it ultimately has to come down to practical application.

Law is meant to be used!

"Zhou Yun, Zhou Yun is a lunatic, a lunatic!"

Why did he become an internet celebrity? Wasn't it just to make money? But the other party, after these two incidents, who knows how much he invested.

Damn it, why are there people like this?

He couldn't look at his phone anymore because many people were already @-ing him, telling him to come out and show himself.

But Dong Yunliang didn't know what to say.

Apologize and admit fault? That was impossible. How could he apologize to a young man? He was a theoretical expert in the legal field.

After much deliberation, Dong Yunliang decided to play dead. Anyway, the internet doesn't have much memory. After some time, who would remember him? He could just open a new alt account.

However, after thinking about it, Dong Yunliang still posted a message using a small account.

"Zhou Yun doing this is purely problematic, isn't it?"
