160: Enjoy yourself here, don't think about the case

Anyone who frequently handles administrative lawsuits knows that some administrative lawsuits require administrative reconsideration as a prerequisite.

This means that before you file an administrative lawsuit, you must go through administrative reconsideration, and only then will the Court accept your case.

If you go directly to file a lawsuit, the Court will not accept it.

According to Article 23, Paragraph 4 of the Administrative Reconsideration Law, if an application for government information disclosure is made and the administrative agency refuses to disclose it, administrative reconsideration is a mandatory prerequisite.

Therefore, Zhou Yun must undergo administrative reconsideration.

The agency for administrative reconsideration is the Administrative Reconsideration Bureau, a new unit established in various places in 2021, but in fact, it is just a signboard for the Bureau of Justice.

Upon arriving at the location, Zhou Yun quickly found the office responsible for receiving administrative reconsideration applications.

Don't ask why he didn't mail it; of course, it's because delivering it directly is the fastest way.

Mailing also has its advantages, which is not needing to get an acceptance receipt; just sending it out is enough.

Of course, what is being referred to here is postal service; for materials like these, it's best to use postal service for mailing.

The staff member took the refusal to disclose reply letter and looked at it, somewhat surprised, saying, "Was this received today?"

Zhou Yun nodded with a slight smile, "Yes, to be precise, I received it ten minutes ago."

The staff member fell silent, then began to meticulously review the documents.

After about ten minutes of review, an acceptance receipt was issued.

With everything done, Zhou Yun returned to wait for news, but he certainly wouldn't just wait quietly.

After all, normally, the other party would definitely drag things out, and it's not his style to do nothing for so many days and just wait for the outcome.

So, Mr. Zhou opened a live stream in his hotel room, preparing to handle a few administrative lawsuits to practice.

This is quite normal, right? After all, the reconsideration will definitely not be supported, so a lawsuit will definitely be filed; might as well practice first.

As the saying goes, if you often walk by the river, how can your shoes not get wet? Since they're wet... might as well take a bath.

He believed that a good person like President Lan would definitely support him.

Inside the hotel room, Zhou Yun had already started picking cases.

"You were driving, and the other party forcefully cut you off, then got out of the car and argued, and they threw the first punch, but your retaliation was deemed mutual combat? You were detained for five days without mediation?"

The connected audience member said helplessly, "Lawyer Zhou, it's not that I'm too serious, it's just that this is a bit too much bullying. Cutting me off is one thing, but they even specifically stopped the car and got out to curse at me."

"Afterward, when I called the Police, they just told me to mediate, and if I didn't, I'd be detained. I just refused to agree, and as a result, I was given five days of administrative detention."

"Lawyer Zhou, what do you suggest I do now?"

Zhou Yun heard this and said, "Do you have any evidence? Oh, a dashcam video, that works. Send it over, and I'll take a look."

After quickly watching the video, Zhou Yun said directly, "I'll take your case. I'll file an administrative lawsuit for you first, and then apply for a temporary suspension of enforcement."

This is something many people don't know: when facing administrative detention, if you disagree with the punishment and want to file an administrative reconsideration or administrative lawsuit, you can apply for a temporary suspension of enforcement.

The advantage of doing this is that if the reconsideration or lawsuit is successful, you won't have to go in.

This is much better than those cases where the detention is revoked after you've already been detained, because then you've already served your time in the detention center.

But there's a prerequisite for this: you must first file an administrative reconsideration or administrative lawsuit, and only then can you apply to the Public Security Bureau for a temporary suspension of enforcement.

Of course, you must apply yourself. If you don't apply or don't know that you can suspend enforcement, then there's nothing that can be done.

The legal basis is Article 107 of the Public Security Administration Punishment Law.

It stipulates: If a person subject to punishment disagrees with the administrative detention decision and applies for administrative reconsideration or files an administrative lawsuit, he may submit an application to the Public Security Bureau for a temporary suspension of administrative detention.

After you submit it, the Public Security Bureau will review it. If the review passes and it is determined that a temporary suspension of enforcement will not pose a danger to society, then it can be granted.

Then you need to find a special guarantor, usually someone with a local household registration, a local residence, no relation to the case, political rights, and a certain economic foundation.

Because if you evade enforcement, the guarantor will be fined.

If you can't find a suitable guarantor, it doesn't matter; just pay a deposit, which is determined by the number of days you're detained, at two hundred yuan per day.

"So you just need to pay a thousand yuan deposit, and I'll help you apply."

"Also, the other party, as the provocateur, also received five days of detention, right? Okay, I'll also report them."

Report what? Of course, it's to report that the punishment for the other party was too light.

"Even if it was a fight, as the instigator, their punishment should not be the same as the one who was forced to retaliate."

Zhou Yun then explained in detail the differences in these operations: the lawsuit was to prevent himself from being detained, and the report was to increase the other party's detention...

Lawyer Zhou always liked to finish what he started.

The parties and netizens watching the live stream were all stunned...

This case was taken, and then it was the next case...

In one evening, Zhou Yun took on three cases, all administrative lawsuits.

Although none of them were major cases, under normal circumstances, no Lawyer would be willing to take them.

They wouldn't earn much money and might even get into a lot of trouble.

Time quickly moved to the next day. Zhou Yun reported the relevant cases back, and Old Zhuang chuckled, then forwarded them to the Provincial Lawyers Association.

In the Provincial Lawyers Association office, Chairman Lan Hongbo's hands trembled as he opened the relevant documents. The previous case had an administrative reconsideration filed, and there was a ninety percent chance it would eventually lead to an administrative lawsuit.

That was already enough, but then he filed three more, playing a super multiplier, right?!

He felt his heart beating a little fast. He probably shouldn't have sent Zhou Yun out in the first place!

He was fine when he was in Jinghai, but once he went out, he felt like a wild horse unbridled, so free and easy, doing whatever he wanted.

The crucial thing was that the Provincial Lawyers Association had to cover everything in the end...

After thinking for a long time, Chairman Lan Hongbo made a call, "Hello, President Zhuang, why don't you try to persuade Lawyer Zhou? Yes, tell him to take it easy, there's no need..."

"What do you mean you can't persuade him? Aren't you the Law Firm Director?"

"Oh, he beat up the previous Law Firm Director... Ahem, well, let's leave it at that for now. I can handle it, no problem."

At Zhentian Law Firm, Old Zhuang hung up the phone and then dialed Zhou Yun's number.

"President Lan said it's nothing, telling you to step up your efforts. Don't worry, he's got your back. Even if you sue our Jiangdong Provincial Government, he'll be fine..."

Time quickly came to the next day. Zhou Yun met with the three parties, collected evidence, and signed contracts.

Because they were specially selected, all three parties were locals of Yinshan District.

After getting the evidence and signing the contracts, Zhou Yun returned to his room to prepare the complaint and organize the materials. He did this step very quickly because it really wasn't difficult.

The only problem was that very few people would do it this way.

Everything was ready. Seeing that it was only two in the afternoon, he immediately set off for the Lüshan City Railway Transportation Court, also to get a look at the environment beforehand.

He quickly arrived at the location. When Zhou Yun took out the three case files one by one, the previously expressionless face of the staff member finally changed.

"Three cases?"

Zhou Yun smiled a little shyly, "Yes, only three today."

Oh, that's good... Huh? The staff member's eyes widened, "Wait, what do you mean 'only three today'?"

Zhou Yun still maintained that embarrassed smile, saying, "It means there might be more tomorrow, not necessarily three."

"It could also be four or five. Mainly, I filed an administrative reconsideration, and the process there is too slow, so I have to find some fun."

This was Zhou Yun's definition of these cases; they weren't really cases, just his fun.

"Oh, right, if the reconsideration isn't approved in a while, I'll probably come to your place again. At that time, could your procedures be a little faster? Mainly, I feel uncomfortable when I'm idle."

At this moment, the staff member swore she really wanted to say, "Are you out of your mind? What kind of normal person treats administrative lawsuits as fun?!"

For Zhou Yun, it was indeed like that. What were criminal cases? They were for relaxation. Administrative cases, then, were definitely for fun.

Then, the staff member saw the name of the agent on the complaint and swallowed her words back.

After all, Jinghai and Lüshan were next to each other, and Mr. Zhou's name was also circulating in the political and legal system here, just not as loudly as in Jinghai.

Forget it, better not say anything. The other party had a license.

So the staff member reviewed the materials at the fastest speed and then issued three acceptance notices.

Then, Zhou Yun took the acceptance notices and went straight to the Yinshan District Public Security Bureau.

It's not necessary to have a case acceptance decision; as long as it can prove that you have started administrative reconsideration or administrative litigation, that's enough.

Half an hour later, in the branch office, the Police Officer looked at the "Application for Suspension" in front of him with some helplessness. The key was that the person in front of him made him even more helpless.

"Comrade, I'm handing the materials to you. You can review them first. It's fine if you don't suspend it anyway. Then, which floor is your Supervision Office on? I'll go make a report."

The Police Officer looked bewildered, "Lawyer Zhou, what are you reporting?"

Zhou Yun said as if it were obvious, "I'm going to report the case handler. The side that provoked and started the fight actually received the same punishment as the side that retaliated after being hit."

"This is definitely not acceptable; it needs to be investigated to see if there's a problem."

Police Officer: "..."

Say no more. The Police Officer decided to report it quickly, investigate it as soon as possible, and see what was going on. If the punishment could be revoked, they would revoke it themselves.

Zhou Yun was someone who really would pursue things to the end.

Here, that saying needs to be used again: You can't investigate everything, what if something is found?

....................

Time slowly passed. He didn't know how others were doing, but Zhou Yun was having a blast, so much so that he was almost neglecting his main case.

After all, President Lan might not be able to hold on much longer, so he had to seize the opportunity quickly. Such opportunities would be hard to come by in the future.

Other things weren't an issue, mainly the Lawyer fees. If he took cases himself, he definitely couldn't be so reckless; even the smallest case had a basic fee.

He couldn't keep paying out of his own pocket; if he did, his colleagues would probably want to kill him.

Meanwhile, on the other side, the leader of the Silver Fir District Education Bureau suddenly seemed to remember something and asked, "What's the situation with the reconsideration? What has Zhou Yun been doing lately?"

The assistant next to him, after finishing a phone call, looked bewildered and said, "Zhou Yun... Zhou Yun has been handling administrative lawsuits recently. He has sued eight units in our district, and some have even been sued twice!"

"He said he was bored and that someone was paying the Lawyer fees anyway, so it was a good chance to practice."

"There's also a rumor that these units are now urging the administrative reconsideration department in the district to release the results quickly and not to drag it out."

What?! The Education Department leader was instantly stunned.
